9am is a social photography app operated by an individual based in Canada. Photos you take develop until 9am the following day, then appear in a feed shared with friends. These terms govern your use of 9am. By creating an account or using the app, you agree to these terms and our Privacy Policy. If you do not agree, do not use the app.
You must be at least 13 years old to use 9am. You must provide accurate information and confirm your age and acceptance of these terms when signing up. You may not use the app if you are prohibited from doing so under applicable law. One account per person.
Keep your login credentials secure. You are responsible for activity on your account. If you believe someone accessed your account without permission, contact us at privacy@9amphoto.app.
When you take a photo in 9am, it appears blurred until 9am the following day, when it becomes visible to you and your friends. After its active period, it expires. Free users see expired photos as blurred. Pro subscribers can view their own expired photos for up to 7 additional days. All photo data is permanently deleted from our servers 8 days after the photo was taken. You can delete your own posts at any time.
You keep ownership of photos and content you post. By posting, you grant us a limited license to store, process, display, and deliver that content within the app to you and your friends for as long as we retain it under our deletion policy. You represent that you have the right to post your content, that it does not violate anyone else's rights, and that you have consent from people identifiable in your photos where required, especially minors.
Do not post illegal, harassing, hateful, sexually explicit, violent, or non-consensual content. Do not post child sexual abuse material. Do not impersonate others, threaten users, spam, scrape the service, or attempt unauthorized access. We may remove content, suspend or terminate accounts, and cooperate with law enforcement when required.
You can report posts or users through the in-app menu. We review reports manually and aim to respond to serious safety issues promptly. We are not obligated to monitor all content in advance but may act when we become aware of violations.
You can block other users in the app. Blocked users will not appear in your feed and cannot interact with you through friend features while blocked.
9am Pro is an optional subscription that unlocks extended access to your own expired photos, instant save to camera roll, and additional camera profiles. Purchases are through Apple's In-App Purchase system. Payment, billing, and refunds are handled by Apple. Manage or cancel in your Apple ID settings.
Photos are automatically deleted from our servers 8 days after they are taken. You may delete your account at any time in the app under Edit Profile. Account deletion permanently removes your profile, posts, and related account data, subject to brief processing time and any legal retention we are required to keep.
If you believe content on 9am infringes your copyright, email privacy@9amphoto.app with identification of the work, the material, and your contact information. We may remove or disable access to disputed material.
You may stop using 9am and delete your account at any time. We may suspend or terminate your account if you violate these terms or to protect users and the service. We will try to give notice when reasonable but are not required in every case.
9am is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service. Photos may be lost under our retention policy or if you delete them.
To the fullest extent permitted by law, the operator of 9am will not be liable for indirect, incidental, special, or consequential damages arising from your use of the app. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or $50 CAD, whichever is greater.
These terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law rules. Courts in Ontario have exclusive jurisdiction, except where consumer protection laws in your country require otherwise.
We may update these terms from time to time. We will post the revised version here and update the effective date. Material changes may be communicated in the app. Continued use after changes means you accept the updated terms where permitted by law.
